BY USING THIS WEBSITE, YOU AGREE TO THE TERMS AND CONDITIONS HEREIN. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, PLEASE DO NOT USE THIS WEBSITE.

1. General

Welcome to our Ward Emergency Preparedness Plan. This website was created to help mitigate the effects of local and widespread emergencies affecting all who reside within the boundaries of the Quail Ridge 2nd Ward, Ammon Idaho East Stake, of the Church of Jesus Christ of Latter-Day Saints.  The church cannot be expected to provide for every ward member in case of public or personal disaster.  It is therefore necessary that each home and family do what they can to assume the responsibility for their own hour of need during an emergency (see General Conference, Elder James E. Faust, April 1986, "The Responsibility for Welfare Rests with Me and My Family").  This Plan is for Stake and Ward informational purposes in preparing for, and reacting to, disasters affecting those residing within our ward boundary.

This website is not officially sponsored or endorsed by the Church of Jesus Christ of Latter-Day Saints and, as a result, is not authorized to use the church's official logo.  The Ward Emergency Preparedness Plan found herein has been reviewed and approved for use by the Quail Ridge 2nd Ward Bishopric.  Updates and modifications periodically made to the Plan which affect its guiding principles and implementation are reviewed and approved by the Bishopric prior to it being conjoined with the overall Plan. 

2. Terminology

The term "Service" used herein shall refer to any and all content, information, services, forms, databases, photographs, etc. found in, or associated with, this website.

The term "Administrator" used herein shall refer to this website's Administrator (also known as webmaster, web developer, network system administrator, computer system administrator).  The Administrator is responsible for all aspects of keeping this website's content and design fresh, relevant, and fully functional. The Administrator manages the day-to-day operations of the Ward's online emergency preparedness presence. The Administrator oversees the functionality of the website, ensuring its performance and capacity are maintained at optimal levels, and managing the user experience. By regularly updating content, implementing design changes, managing access controls, and coordinating with content creators and technical staff, the Administrator ensures the site remains current, engaging, and accessible to its audience. Additionally, the Administrator monitors website traffic, analyzing visitor data, and implementing strategies for improvement, thereby supporting the Ward's broader digital strategy and goals. Through these activities, the Administrator contributes to the seamless operation and continued success of the Ward's online emergency preparedness platform.

3. Subscription / Membership 

No subscription or website membership is required to gain access to this site.

Access to this website is password protected by the Administrator.  This password is shared with those who reside within the boundaries of the Quail Ridge 2nd Ward, Ammon Idaho East Stake, of the Church of Jesus Christ of Latter-Day Saints.  The password is also shared with certain Ammon Idaho East Stake leaders who have an incontrovertible need-to-know.  

 

Additional pages within this website are further protected with a separate and unique password that is different from the password used to access the overall general website.  This password is shared with those who have been designated as Emergency Response Team Members. The password is also shared with certain Ammon Idaho East Stake leaders who have an incontrovertible need-to-know.

The providing of these passwords is at the sole discretion of the website Administrator in collaboration with the Quail Ridge 2nd Ward Bishopric and/or Ammon Idaho East Stake leaders.  

 

Provided that you are eligible for use of the Service and subject to these Terms and Agreements, you are granted a limited license to access the Service and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright and other proprietary notices intact.

 

Any use of the Service or the Site Content other than as specifically authorized herein, without the prior written permission of the Administrator, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trade-mark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms and Conditions shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise.  You shall not upload, post or otherwise make available on the Service any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with you.

4. Password Holder's Responsibilities

A.  Sharing Passwords with Others

It is strictly prohibited to share passwords with any other individual, even if they are a close relative, a member of the Quail Ridge 2nd Ward, or Stake leader. If you encounter someone who asserts that he/she has a valid need to possess any password associated with this website (whether the assertion is legitimate or not), you are proscribed from sharing the password(s).  Only the website Administrator, in collaboration with the Quail Ridge 2nd Ward Bishopric and/or Ammon Idaho East Stake leaders, is authorized to share passwords with others.  All persons requesting passwords should contact the website Administrator who will determine if a legitimate need-to-know exists. If a legitimate need-to-know is validated, then the website Administrator will share the appropriate password(s).

B. Uploading Content via the Forms Provided

Password Holders shall not post, transmit, or upload through this site any information or material that:

  • Violates or infringes in any way upon the rights of others.

  • Is unlawful, threatening, abusive, defamatory, or invasive of privacy or public rights.

  • Contains sensually provocative material or language.

  • Is vulgar, obscene, profane or otherwise objectionable.

  • Encourages conduct that would constitute a criminal offense, gives rise to civil liability, or otherwise violates any law.

  • Intentionally conveys false information.

  • Purposefully and/or deliberately misleads. 

  • Negligently, carelessly, or irresponsibly is distorted or inaccurate.

  • Is intended to be a joke or prank. 

  • Bullies or makes fun of another person.

 

C. Personal Information

Password Holders have access to Personal Information (e.g., names, phone numbers, addresses, etc.) that is similarly disclosed in the LDS Church's "Member Tools" app and on the Church's web sites.  As such, you are required to provide the same level of protection of Personal Information found in this website as you would for Personal Information disclosed in the Church's "Member Tools" app and on the Church's web sites. You agree to retain the Personal Information in strict confidence, to protect the security, integrity, and confidentiality of such information and to not permit unauthorized access to or unauthorized use, disclosure, publication, or dissemination of the Personal Information. You agree NOT to share, provide copies, loan, etc. the Personal Information with others who cannot access Quail Ridge 2nd Ward's Personal Information in the LDS Church's "Member Tools" app.

D. Solicitations

You shall not post or transmit through this website any material that contains advertising or any solicitation with respect to products or services. You shall not use this website to advertise or perform any commercial solicitation, including, without limitation, the solicitation of users to become subscribers or members of other paid or non-paid services and/or products, even if those products or services are related to emergency preparations.  You may not use this website to conduct surveys, polls, or gather information that is unrelated to Quail Ridge 2nd Ward emergencies, Quail Ridge 2nd Ward crisis management, and Quail Ridge 2nd Ward emergency preparations.

E.  Spoofing / Impersonation

You may not obscure or misrepresent your geographical location, forge headers, use proxies, use IP spoofing or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send on or through this website. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

F.  Infringement 

Any conduct by you that in the Administrator's discretion restricts or inhibits any other user from using or enjoying the Service will not be permitted.

G.  Modifications

No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, transmitted or posted in any form or by any means, in whole or in part, on any social media platform, internet, intranet or extranet site without the Administrator's prior written permission.

H.  External Databases

You may not upload or incorporate the site's content or information in any other database or compilation.  

5. Breach of Policy

Failure to comply with any provision set out in this Agreement constitutes a breach of policy, regardless of being a breach of duty, material breach, partial breach, total breach, etc.  Access to this website is revocable by the Administrator at any time without notice and with or without cause.

The Administrator of this website reserves the right to immediately cancel or terminate your access to the Service (or any part thereof)  and/or your customer account, if any.  In the Administrator's sole discretion and without prior notice or liability, the website Administrator may discontinue, modify or alter any aspect of the Service provided to you.

Determinations and outcomes regarding any infringement or breach of policy is subject solely to the interpretation and discretion of the website Administrator in collaboration with the Quail Ridge 2nd Ward Bishopric and/or Ammon Idaho East Stake leaders.  We may take actions we deem reasonably necessary to prevent fraud, abuse, and infractions including placing restrictions on the amount of content or other services that can be accessed from this website.

You agree that any termination or cancellation of your access to, or use of, the Service may be affected without prior notice. If you do not abide by the terms of this Agreement, you agree that we may immediately deactivate or delete your customer account, if any, and all related information and/or files in your user account and/or bar any further access to such information and/or files and/or the Service (or part thereof). Further, you agree that the website Administrator shall not be liable to you or any third-party for any termination or cancellation of your access to, or use of, the Service. You acknowledge that your only right with respect to any dissatisfaction with any modification of, or discontinuation to, the Service or any policies or practices by the Administrator in providing the Service, including without limitation, any change in content, is to cease using the Service and cancel or terminate your subscription or customer account, as applicable.

6. Monitoring for Compliance

The Administrator shall have the right, but not the obligation, to monitor the content of the Service to determine compliance with these Terms and Conditions and any operating rules established by the Administrator and to satisfy any law, regulation or authorized government request. The Administrator shall have the right in his/her sole discretion to edit, refuse to post or remove any material submitted to or posted on the Service. Without limiting the foregoing, the Administrator shall have the right to remove any material that, in his/her sole discretion, finds to be in violation of the provisions hereof, its content policy, or otherwise objectionable. The Administrator reserves the right to remove, without notice, any posting for any reason. The Administrator has no obligation to delete submissions that you may find objectionable or offensive.

7. Trademarks

Domain names, logos, trademarks, conceptual ideas, and the Plan herein are the exclusive property of the Administrator and is considered "Intellectual Property."  All other trademarks, product names and company names or logos cited herein are the property of their respective owners.

The download of, and access to, any Digital Content is available only to authorized Users and is intended only for such Users' personal and non-commercial use. Any other use of Digital Content downloaded or accessed from the Service is strictly prohibited.

You acknowledge that use or disclosure of any Proprietary Information in a manner inconsistent with this Agreement will give rise to irreparable injury for which damages would not be an adequate remedy. Accordingly, in addition to any other legal remedies which may be available at law or in equity, the Administrator shall be entitled to equitable or injunctive relief against the unauthorized use or disclosure of Proprietary Information. The Administrator shall be entitled to pursue any other legally permissible remedy available as a result of such breach, including but not limited to, damages - both direct and consequential. In any action brought by the Administrator under this Section, the Administrator shall be entitled to recover his/her attorney’s fees and costs related to the breach of this Agreement. 

 

By downloading or otherwise accessing Digital Content from this website, the User hereby acknowledges and agrees to these terms.

8. Third Party Content

Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including content providers and users, are those of the respective author(s) or distributor(s) and not of the Administrator. In many instances, the content available through the Service represents the opinions and judgments of the respective content provider or user. The Administrator neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on the Service by anyone other than the Administrator himself/herself.

9. Indemnification

You agree to fully indemnify, defend, and hold harmless the Administrator and his/her affiliates and their respective directors, officers, employees and agents from and against any and all claims, actions, suits, demands, damages, costs, liabilities, losses, settlements, judgments, and expenses (including reasonable attorneys' fees) arising out of:

 

  • Your use of this website

  • Anyone's use of this website

  • Breaches of this website's Terms and Conditions

  • Violation of assumed obligations or duties identified in the Plan

  • Omission or commission of those implementing this Plan

  • Failure to respond to an emergency in a timely manner

  • Lack of details or nebulous information in the Plan

  • A person's inability to execute the Plan

  • Etcetera

Those from the Ward and Stake level implementing the Plan in this website are volunteers and are not compensated monetarily for their gratuitous services.  Pursuant to Idaho Statute, Title 5, Chapter 3, Section 5:30 (Good Samaritan Law):  

​

"IMMUNITY OF PERSONS GIVING EMERGENCY FIRST AID FROM DAMAGE CLAIM. That no action shall lie or be maintained for civil damages in any court of this state against any person or persons, or group of persons, who in good faith and without compensation, being at, or stopping at the scene of an accident or emergency, offers and administers emergency first aid or emergency medical attention to any person or persons injured in such accident or emergency unless it can be shown that the person or persons offering or administering emergency first aid or emergency medical attention, is guilty of gross negligence in the care or treatment of said injured person or persons or has treated them in a grossly negligent manner. The immunity described herein shall cease upon delivery of the injured person to either a generally recognized hospital for treatment of ill or injured persons, or upon assumption of treatment in the office or facility of any person undertaking to treat said injured person or persons, or upon delivery of said injured person or persons into custody of an ambulance attendant."

Therefore, you agree to hold harmless and to fully indemnify any and all persons who, in good faith, attempt to implement this Plan to assist others during emergencies from the consequences that may occur due to the use of the information or resources provided on this website, including but not limited to: Death, personal injury, physical illness, disability, property damage, unintended harm (physical, mental, psychological), etc.

10. Disclaimer of Warranty; Limitation of Liability

You expressly agree that the use of the Service is at your sole risk. Neither the Service, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that the site  will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the website, or as to the accuracy or reliability of any information, service or information provided through the website.

The website is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose.

11. Restrictions on Use

You are prohibited from violating or attempting to violate the security of the Service, including, without limitation:

(a) accessing data not intended for you, including logging into a server, account, or pages which you are not authorized to access.

(b) attempting to probe, scan or test the vulnerability of a system or network to breach security or authentication measures without proper authorization.

(c) using any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Service or any Site Content, or in any way reproduce or circumvent the navigational structure or presentation of the Service or any Site Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site.

(d) taking any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Service or systems or networks.

13. Severability

If any part, term or provision of this Agreement is held to be illegal, in conflict with any law or otherwise invalid, the remaining portion or portions shall be considered severable and not be affected by such determination, and the rights and obligations of the parties shall be construed and enforced as if the Terms and Conditions (Agreement) did not contain the particular part, term or provisions held to be illegal or invalid.

14. Governing Law and Venue

This Terms and Conditions and all disputes arising out of or in connection with this Terms and Conditions shall be governed by, interpreted under, and construed and enforceable in accordance with, the laws of the State of Idaho, U.S.A., without giving effect to conflict of law principles.

15. Acceptance of Terms
